AI America LLC (“AI America,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the personal information we process in connection with our AI training programs for individuals and organizations.

This Privacy Policy explains how we collect, use, disclose, and protect your information when you:

  • Visit our websites (including any subdomains) or landing pages;

  • Enroll in or participate in any AI America training, course, cohort, or event (including programs under Ohio TechCred or overseen by the State Board of Career Colleges and Schools (SBCCS));

  • Communicate with us by email, phone, or other channels; or

  • Otherwise interact with us where this Privacy Policy is linked or referenced.

You consent to this Privacy Policy by using our Services. If you do not agree with this Privacy Policy, please do not use our Services.

2. Scope & Roles

We may act as:

  • A data controller when we decide how and why to process personal information (for example, when you sign up directly for an AI America course, join our email list, or visit our website); and

  • A data processor / service provider when we process information on behalf of an employer, educational institution, or other organization that sponsors your training. In those cases, that organization’s privacy terms and data processing instructions control many aspects of how your information is used.

If your enrollment is arranged or paid for by your employer or another sponsoring organization (e.g., under Ohio TechCred), that organization may receive information about your participation and completion status as needed for reimbursement and compliance.

3. Information We Collect

The personal information we collect depends on how you interact with us and our Services. We may collect:

3.1 Information You Provide Directly

  • Identification & contact details
    Name, email address, phone number, mailing address, employer name, job title, and similar identifiers.

  • Enrollment & profile data
    Course selections, program and credential interests, employer sponsorship, professional background, learning goals, and similar information.

  • Account & authentication data
    Usernames, passwords, security question responses, and other login credentials for our learning platforms.

  • Payment-related information
    When you pay us directly, payment card details and billing information are typically collected and processed by our payment processors (e.g., merchant banks, payment gateways). We receive limited information such as the last four digits of your card, transaction ID, and payment status.

  • Coursework & assessment data
    Assignment submissions, quiz or exam results, attendance records, project work, participation in discussions, feedback you give about courses or instructors, and survey responses.

  • Support & communications
    Content of emails, support tickets, and other communications with us, including any information you choose to provide (for example, questions about accommodations, scheduling, or career support).

  • Compliance information
    Information needed to comply with TechCred, SBCCS, or similar programs (such as evidence of course completion, credential details, and proof of Ohio residency or employment where required).

In limited circumstances, you may choose to provide sensitive information (for example, disability-related information for reasonable accommodations). Where applicable law requires it, we will only process this type of data with your explicit consent or when otherwise permitted by law.

3.2 Information We Receive from Third Parties

We may receive information from:

  • Employers or sponsoring organizations (e.g., lists of eligible employees, contact details, role information, and confirmation of funding);

  • Training platforms and LMS providers (e.g., learning progress, time spent in modules, and completion status);

  • Payment processors (e.g., payment status, limited card metadata);

  • Marketing or referral partners (e.g., lead source, campaign attribution); and

  • Public or commercially available sources (e.g., business contact databases, social media if you interact with our official pages).

3.3 Information Collected Automatically

When you use our websites or online platforms, we and our service providers may automatically collect:

    IP address, browser type and version, device identifiers, operating system, time zone, referring URLs, pages viewed, links clicked, and session duration.

    • Deliver live and asynchronous instruction, labs, assignments, and assessments;

  2. Administer training for employers / sponsoring organizations

    • Verify eligibility for employer-funded or TechCred programs;

    • Track attendance, progress, and completion;

    • Provide required reports to employer sponsors or relevant state agencies for reimbursement or compliance.

  3. Communicate with you

    • Send transactional communications (enrollment confirmations, schedule updates, service announcements, policy changes);

    • Respond to your inquiries and support requests;

    • Send optional newsletters or marketing communications (where permitted by law and your preferences).

  4. Improve and develop our offerings

    • Analyze course engagement and performance data to improve curricula and instruction;

    • Test and develop new features, tools, and offerings related to AI training;

    • Conduct surveys and research (often using aggregated or de-identified data).

  5. Security, fraud prevention, and legal compliance

    • Maintain the security and integrity of our systems, including monitoring for unauthorized access or misuse;

    • Comply with applicable laws and regulations, including Ohio’s breach notification requirements for personal information and any other applicable state or federal laws;

    • Enforce our terms, protect our rights, resolve disputes, and respond to lawful requests from authorities.

    • For any additional purposes we clearly describe to you at the time of collection, where you choose to provide consent.

5. How We Share Your Information

We do not sell your personal information for money, and we do not share it for cross-context behavioral advertising as those terms are defined in certain state privacy laws.

We may disclose personal information in the following circumstances:

  1. Service providers / vendors
    To third-party service providers who perform services on our behalf, such as:

    • Learning management systems (LMS) and online training platforms;

    • Video conferencing providers;

    • Payment processors;

    • Email and communications tools;

    If your participation is sponsored by an employer or other organization, we may share:

    When required or permitted by law (e.g., in connection with Ohio TechCred reimbursement documentation, audits, or SBCCS oversight), we may share necessary information with relevant government agencies or regulators.

    • Enforce our agreements and protect our rights;

    • Investigate or prevent potential fraud or security incidents;

We aim to maintain a written cybersecurity program with safeguards for personal information that is reasonably consistent with widely recognized cybersecurity frameworks (such as the NIST Cybersecurity Framework or ISO/IEC standards), with the goal of qualifying for the safe harbor provided under the Ohio Data Protection Act (Ohio Rev. Code Chapter 1354), where applicable.

However, no method of transmission or storage is 100% secure. While we work to protect your information, we cannot guarantee absolute security.

7. Data Breach Notification

If we become aware of a security breach that affects your personal information, we will investigate promptly and take appropriate remedial steps. Where required by law, including Ohio’s data breach notification statute (Ohio Rev. Code § 1349.19), we will notify affected individuals and, where applicable, regulators without unreasonable delay and within any legally mandated timeframes (for Ohio residents, generally within 45 days where there is a material risk of identity theft or fraud).

  • For as long as necessary to provide the Services, fulfill the purposes described in this Privacy Policy, and comply with contractual and legal obligations (for example, educational and financial record-keeping requirements relevant to TechCred or SBCCS);

  • For the period in which we may reasonably anticipate a dispute or need to establish, exercise, or defend legal claims.

Where possible, we may anonymize or aggregate data so that it no longer identifies you and may retain such data for research, analytics, and improvement of our offerings.

9.1 Access, Correction, and Deletion

Subject to applicable law, you may have the right to:

  • Access the personal information we hold about you;

  • Correct inaccurate or incomplete information;

  • Request deletion of your personal information (subject to certain legal exceptions, such as for record-keeping or legal claims).

9.2 State-Specific Rights (e.g., California)

AI America is based in the United States, and our Services are intended for users located in the U.S.

If you access our Services from outside the U.S., your information may be transferred to, stored in, and processed in the United States or other countries where our service providers are located. For users in the EEA, UK, or other jurisdictions with data transfer restrictions, we will rely on appropriate legal mechanisms (such as standard contractual clauses) where required by law.
